Basically, the public prosecutor in all courts is the prosecutor. The primacy of the prosecutor is also confirmed by art. 3 § 1 of the law on the prosecutor's office, which states that the prosecutor's duty is to conduct or supervise preparatory proceedings in criminal matters and to act as a public prosecutor in courts;
The public prosecutor is a party to proceedings that does not represent his own interest but the public interest. The public prosecutor is also required to remain objective. Because of the interest he represents and the objectivity he must maintain, the public prosecutor is the only active party who can bring legal remedies in favor of the accused.
In misdemeanor cases, the police play the role of public prosecutor.
