{"id":668,"date":"2025-04-01T16:34:00","date_gmt":"2025-04-01T14:34:00","guid":{"rendered":"https:\/\/karne.pl\/index.php\/?p=668"},"modified":"2025-06-15T16:34:52","modified_gmt":"2025-06-15T14:34:52","slug":"resumption-of-conditionally-discontinued-proceedings","status":"publish","type":"post","link":"https:\/\/karne.pl\/index.php\/resumption-of-conditionally-discontinued-proceedings\/","title":{"rendered":"Resumption of Conditionally Discontinued Proceedings"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>Conditional discontinuation of proceedings is one of the legal mechanisms designed to subject the perpetrator to a probationary period-of the three available under the Polish Penal Code, it represents the most favorable option for the defendant.<\/p>\n\n\n\n<p>Unfortunately, it may happen that during the probationary period (1\u20133 years), the person subject to conditionally discontinued proceedings engages in conduct requiring renewed court intervention.&nbsp;The resumption of conditionally discontinued proceedings is mandatory&nbsp;if the perpetrator commits an intentional crime for which they are convicted.<\/p>\n\n\n\n<p>Proceedings may also be resumed&nbsp;at the court\u2019s discretion&nbsp;(facultatively) in cases of serious legal violations, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Commission of another crime\u00a0(even if unintentional);<\/li>\n\n\n\n<li>Failure to comply\u00a0with obligations imposed by the court in the discontinuation ruling (e.g., penal measures, compensatory measures, prohibitions, or probationary supervision).<\/li>\n<\/ul>\n\n\n\n<p>Resumed proceedings follow standard procedural rules.
