From February 13, 2024, among others, Article 197 § 1 of the Penal Code will change. According to the new wording of this provision, not only causing another person to have sexual intercourse by unlawful threat or deceit but also in another way will be punishable. In addition, in order to establish the commission of a crime, it will also be necessary to establish the lack of consent of another person.
The question arises how the courts will approach the issue of proving the lack of consent to sex, and what other ways (apart from unlawful threat and deceit) of causing sexual intercourse will be considered punishable.
